SB 79 will allow developers to build up to 80 housing units per acre, up to five stories high, within a 1/2-mile radius of any transit stop, on any parcel of land they own (or buy). Within a 1/4-mile radius of transit stops, 100 units per acre and seven story developments will be allowed. These developments would be ministerially approved, meaning local codes, zoning, infrastructure, etc. will not be considered and local government will have virtually no control. All developments can be amplified by density bonuses, with little to no affordability requirement. With the dedicated bus lane coming to HWY 101, this means that every single GG Transit stop will have a bullseye on it, as well as all SMART stations and the ferry terminals. Much of the press coverage has perpetuated a deceptive narrative that SB 79 is merely a law to “allow housing near transit.” This is false. SB 79 will allow developers a free hand to remake whole neighborhoods in Marin (and much of the state) into large swaths of expensive apartment buildings. The bill will be heard in only one more committee (as early as the week of August 18th), and, if it passes, will go to an Assembly floor vote soon after. The statewide protest is timed to take place before the Assembly vote. San Diego, Los Angeles, and San Francisco are major participants.
